By accessing and using TenWasap's services, you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to abide by these Terms, please do not use the service.
These Terms govern your use of TenWasap's WhatsApp AI automation platform operated by Tenworks Technology ("we", "us", or "our").
2. Description of Service
TenWasap provides communication automation services, including but not limited to:
- WhatsApp conversation automation and routing
- Integration with WhatsApp messaging platform through technical methods
- Workflow configuration, templates, and message handling
- Team collaboration and assignment tools
- Analytics, activity logs, and performance reporting
- Related technical support services
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice.
3. Third-Party Service Notice
TenWasap is an independent third-party service provider and is NOT affiliated with, endorsed by, or officially connected to WhatsApp LLC, Meta Platforms, Inc., or any of their subsidiaries or affiliates.
We provide automation services that integrate with WhatsApp messaging platform through available technical methods. Your use of TenWasap is subject to both these Terms and WhatsApp's own Terms of Service.
Important: Our WhatsApp integration services utilize available technical methods to connect with WhatsApp messaging. Service availability depends on WhatsApp's platform policies and technical infrastructure. We are not responsible for service disruptions caused by WhatsApp platform modifications, policy enforcement, or detection systems.
You must comply with:
- WhatsApp Terms of Service
- WhatsApp Business Messaging Policy
- All applicable laws governing business communications
Violation of WhatsApp's policies may result in suspension or termination of your WhatsApp account, which is beyond our control. You are solely responsible for ensuring compliance with WhatsApp's terms and all applicable laws.
4. User Accounts and Registration
To use our services, you must:
- Be at least 18 years old or have parental consent
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly update any changes to your account information
- Accept responsibility for all activities under your account
You are responsible for maintaining the confidentiality of your account and password and for restricting access to your devices.
5. Acceptable Use Policy
You agree not to use our services for:
- Illegal activities or content that violates applicable laws
- Distributing malware, viruses, or harmful code
- Spamming, phishing, or fraudulent activities, including bulk unsolicited messaging
- Violating WhatsApp and third-party platform policies
- Violating WhatsApp's Business Messaging Policy, including but not limited to:
- Sending spam or unsolicited messages
- Failing to obtain proper user consent before initiating conversations
- Violating 24-hour messaging window rules
- Using unapproved or non-compliant message templates
- Sharing sensitive personal, financial, or health data inappropriately
- Impersonating other businesses or individuals
- Engaging in prohibited promotional practices
- Violating intellectual property rights
- Harassment, abuse, or threatening behavior
- Adult content or services
- Cryptocurrency mining without explicit permission
- Activities that may harm our infrastructure or other users
We reserve the right to suspend or terminate accounts that violate this policy. WhatsApp may also independently suspend or terminate your WhatsApp account access for policy violations.
6. Payment Terms
Billing and Payments
- Fees are charged in the currency displayed at the time of purchase
- Payments are processed through secure third-party providers
- You must maintain valid payment information
- Automatic renewals may apply to certain services
Refunds and Cancellations
- Refunds are generally not provided for used services
- Pro-rated billing may apply for service upgrades or downgrades
- Account termination may result in immediate service suspension
- Data backup and retrieval are your responsibility before cancellation
7. Service Level Agreement
While we strive to provide reliable services, we do not guarantee:
- 100% uptime or availability
- Uninterrupted service operation
- Error-free service performance
- Specific response times for support requests
We will make reasonable efforts to maintain service availability and provide timely support.
Service Availability Disclaimer: Our WhatsApp integration services depend on third-party messaging infrastructure and are subject to technical changes, policy enforcement, and platform restrictions beyond our control. We do not guarantee uninterrupted WhatsApp connectivity and are not liable for service disruptions caused by platform changes, policy updates, or account restrictions.
8. Data and Privacy
You retain ownership of your data and content. You are responsible for backing up your data. We may access your data only as necessary to provide services or comply with legal requirements.
WhatsApp Data Access: We process WhatsApp data to facilitate messaging automation services. WhatsApp maintains its own data policies that apply to messages sent through their platform. You must ensure you have proper consent from your customers to message them via WhatsApp and process their data in accordance with applicable privacy laws.
Our Privacy Policy governs how we collect and use your information. You grant us a limited license to host, store, and process your data solely to provide our services.
9. Intellectual Property
All intellectual property rights in our services, including software, documentation, and trademarks, remain our property or that of our licensors. You may not:
- Copy, modify, or distribute our proprietary software
- Reverse engineer or attempt to extract source code
- Use our trademarks without permission
- Create derivative works based on our services
Note: WhatsApp, WhatsApp Business API, and related marks are trademarks of WhatsApp LLC and Meta Platforms, Inc. We do not claim any ownership of these marks.
10. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid for services in the past 12 months
- We are not responsible for data loss, business interruption, or lost profits
- You use our services at your own risk
- We are not liable for suspensions, terminations, or restrictions imposed by WhatsApp or Meta on your WhatsApp account for any reason, including but not limited to automation detection, policy violations, or platform policy changes
- We are not responsible for any inability to access or use WhatsApp services due to technical changes, security measures, or platform restrictions
Some jurisdictions do not allow limitation of liability; these limitations may not apply to you.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:
- Your use of our services
- Your violation of these Terms
- Your violation of any third-party rights, including WhatsApp's terms and policies
- Your content or data hosted on our platform
- Your messaging practices or violations of applicable communications laws
12. Termination
Either party may terminate this agreement:
- At any time with reasonable notice
- Immediately for material breach of these Terms
- If required by law or regulation
WhatsApp-Related Termination: Services may be suspended or terminated if WhatsApp restricts or terminates access to your WhatsApp account for any reason, including policy violations, automation detection, or platform changes. We are not liable for suspensions or terminations related to WhatsApp platform access. It is your sole responsibility to maintain compliance with WhatsApp's policies and accept the risks associated with using automation services.
Upon termination, your access to services will cease, and we may delete your data after a reasonable period.
13. Governing Law
These Terms are governed by the laws of Malaysia. Any disputes will be resolved in the courts of Malaysia. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.
14. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of our services after such changes constitutes acceptance of the new Terms.
